TERMS AND CONDITIONS OF USE

By accessing and using https://indiecare.ai/; IndieCare AI App and Platform (collectively “IndieCare AI”) it is important that you take time to read and accept these terms and conditions. These terms and conditions and any of the documents referred to in the terms and conditions form the legally binding agreement between us relating to IndieCare AI.

Downloading and using IndieCare AI or confirming that you have accepted the terms and conditions are all considered as acceptance to these terms and conditions. These terms and conditions will remain in force from the date of acceptance until terminated by the Company.

“We” or “the Company” means IndieCare AI Solutions Private Limited, whose registered office address is at, 1902, Oberoi Gardens, Thakur Village, Kandivali East, Mumbai 400101.

“You / Your” means User(s) of IndieCare AI.

IndieCare AI is not a substitute for ordinary means of contacting emergency services for animal wellbeing. If you are a victim of animal bite or in immediate danger or any animal is suffering medical emergency, please call appropriate local authorities and do not rely solely on IndieCare AI. Even if your mobile phone and IndieCare AI have connectivity, IndieCare AI does not guarantee and has no control over whether your messages will be delivered in real-time, promptly accessed by or responded to by any recipient. IndieCare AI is a tech platform to support local authorities and animal caregivers for animal well-being and should not be treated as veterinary service or animal response cell/unit.

The Company is not responsible for any transmission or receipt of any content through IndieCare AI. You accept that the content sent to or from your mobile phone is the sole responsibility of the person, individual or organization from which such content was requested. You are solely responsible for all the content you transmit or receive using IndieCare AI and not the Company. You understand and acknowledge that all texts, files, messages, images or any other material posted, transmitted or linked through IndieCare AI shall be sole responsibility of the person from whom such content is originated.

You agree to evaluate and bear all risks associated with, the use of any content, and under no circumstances will the Company be liable for any content or loss or damage of any kind suffered due to use of the content made available through IndieCare AI. You understand and acknowledge that the Company does not approve content; however, the Company, at its sole discretion, shall have the right (not obligation) to refuse, remove or delete, move any content that is available through IndieCare AI, in the event of violation of these terms and conditions or for any other reason. The Company shall under no circumstances be liable for any content including but not limited to errors or omissions of the content, any kind of loss or damage suffered as a result of using any content made available through IndieCare AI.

You agree not to use IndieCare AI:

• To send content that is harmful to minors in any way;
• To send content to others that may be deemed as unsolicited or unauthorized advertising, promotional materials, junk mail, spam or any other form of solicitation;

• To send content to another person that may be viewed as unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, hateful, infringing libellous, invasive of another’s privacy, or racially, ethnically or otherwise objectionable;
• To disrupt IndieCare AI or networks or servers to IndieCare AI, or disobey any requirements, procedures, regulations or policies connected to IndieCare AI;
• To impersonate any person, individual, entity including but not limited to a company officer, employee or representative or misrepresent your affiliation with the person, individual or entity;
• To violate any applicable local, state, central or international laws intentionally or unintentionally;
• To falsely report events, harass, play pranks or otherwise mislead any recipient or third party emergency responders.

You agree and understand that: upon activation, IndieCare AI allows for notification through text messages, email to the mobile phone listed in your profile; the technical processing and transmission of IndieCare AI, including information provided by You, may involve transmission over various networks and changes to conform and adopt to technical requirements of connecting networks or devices and some or all of the transmissions may not be encrypted or protected.

Limitation of Liability:

To the extent permitted by law, in no event shall the Company be liable for personal / animal injury, death or any direct, indirect, incidental, special, consequential or exemplary damages with the Company, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial or social damages or losses, or corruption of data, arising out of or related to your use or inability to use IndieCare AI, the Company’s servers, any aspect of IndieCare AI software or the messaging service however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if the Company has been advised of the possibility of such damages, these limitation shall apply to the fullest extent permitted by law.

In particular, the Company do not represent or warrant to you that:

1. Your use of IndieCare AI will meet your requirements;
2. Any information obtained by you as a restful of your use of IndieCare AI will be accurate or reliable;
3. Defects in the operation or functionality of any software provided to you as part of IndieCare AI will be corrected;
4. Receipts of proper alerts in event of poor network;
5. IndieCare AI may not get properly installed due to technical issues in your mobile phone;
6. No response from local and other government / quasi-government authorities responsible for care, treatment, protection and well-being of user/animals;
7. Non-functionality of IndieCare AI due to non-fulfilment of your

You acknowledge and agree that you are solely responsible for all contents stored on or retrieved from your mobile phone and that it is your sole responsibility to keep the information in IndieCare AI updated, accurate and complete. The Company will not be held liable for your failure to make changes in the contact information or profile.

You acknowledge and agree that any content downloaded or otherwise obtained through the use of IndieCare AI is done at your own discretion and risk and you will be solely responsible for any damage to your mobile phone or loss of data that results from the download of any such content.

No advice or information (whether oral or written) obtained by you from the Company on or via IndieCare AI will create any warranty or condition not expressly stayed in the agreement.

You hereby waive any and all claims or cause of action, arising from or relating to IndieCare AI and its use.

You agree not to:

1. sub-license, sell, assign, rent, lease, export, import, distribute or transfer or otherwise grant rights to any third party in IndieCare AI, website and its software;
2. use IndieCare AI and its software or cause to be used within or to provide commercial products or services to third parties;
3. remove, obscure or alter any copyright notices or other proprietary notices included in IndieCare AI and its software;
4. undertake, cause, permit or authorize modification, creation of derivative works or improvements, translation, reverse engineering, decompiling, disassembling, decryption, hacking, discovery or attempted discovery of the source code or protocols of IndieCare AI and its software or any part or features thereof.

The Company’s Privacy Policy describes how we handle the personal information of users/animals registered on IndieCare AI. Please read the entire Privacy Policy before submitting, uploading and using IndieCare AI. By using IndieCare AI, you agree to the terms of the Company’s Privacy Policy. When you submit information through IndieCare AI you consent to the collection, use and disclosure of that information in accordance with the Privacy Policy. The Company reserves the right to update the Privacy Policy whenever necessary, without prior notice.

The use of IndieCare AI may include links to other websites, content and resources. The Company may have no control over such websites, content or resources which are provided by third parties (“Third Party Content”). You acknowledge and agree that the Company is not responsible for the availability of any Third Party Content, and does not endorse any advertising, products or other materials on or available via Third Party Content. You acknowledge and agree that the Company is not liable for any loss or damage that may be incurred by the User as a result of the availability or use of any Third Party Content, or as a result of any reliance placed by you on the completeness, accuracy or existence of Third Party Content, including any advertising, products or other materials on or available via Third Party Content.

REGISTRATION:

During the registration process, you will be asked to provide information including but not limited to e-mail address, your name, one or more contact number(s) and contact information of your designated recipients. 

PROFILE INFORMATION:

In the profile section of IndieCare AI, you will be asked to provide certain personal information including third party contact information. The information so provided is retained by the Company and is governed by its Privacy Policy. You are requested to keep your mobile phones safe and secure and out of reach of others and any information entered is at the risk that it may be viewed on your mobile phones.

We reserve the right to modify these terms and conditions at any time. Your continued use of IndieCare AI after changes are posted constitutes acceptance of the revised terms and conditions.

You have read, understood and agree to the users’ terms and conditions of third party(ies).

DISCLAIMER:

IndieCare AI contains general information only, and neither the author, individuals who have helped in preparation, nor the organizations they represent are, by means of IndieCare AI, rendering any professional advice and services. IndieCare AI is not a substitute for such professional advice and services, nor should it be used as a basis for any decision or action that may affect you or your business. Before making any decision or taking any action that may affect you or your business/animal, you should consult a qualified professional advisor. Neither the author, individuals who have helped in preparation, nor the organizations they represent shall be responsible for any loss sustained by any person who relies on IndieCare AI.

The Company shall not disclose any information (including but not limited to Confidential Information) of user to the any other party. Further, the Company agrees and undertakes to regard and preserve the information disclosed, received or granted access to by user.

By using IndieCare AI, the user consents to the terms and conditions. By submitting / filling the required information in IndieCare AI, the user will be treated as having given permission for processing the same in a manner provided in this terms and conditions.

I hereby authorize and give consent to IndieCare AI Solutions Private Limited to send me, either through itself or through any third party service provider, from time to time, various information / alerts / SMS and other message or calls or commercial communication, and other services on the aforesaid listed telephone numbers, whether these numbers are registered with National Do Not Call Registry / Listed in National Customer Preference Register or not. I also confirm that by sending any of such message / calls, I will not hold IndieCare AI Solutions Private Limited, its third party service provider liable / institute complaint under the Telecom Commercial Communications Customer Preference (TRAI) Regulations, 2010 or such other applicable regulations including any amendment thereof, as may be applicable time to time.
